Elder Law

Protection from financial abuse

Sometimes, older clients are vulnerable to abuse by others in relation to financial arrangements which are not appropriate for their needs or are otherwise detrimental to their rights. O’Shea Lawyers is keenly aware of these issues and can advise its older clients on their rights and obligations under any document, arrangement or agreement proposed to them by other persons.

Powers of Attorney

It may be necessary for an older person to grant someone they trust a Power of Attorney. We can advise on the differences between a General Power of Attorney and an Enduring Power of Attorney and how they should be drafted to best protect our client’s interests.

Retirement Village and Nursing Home Documentation

We have extensive experience with explaining and negotiating the documents produced by Retirement Villages and Nursing Homes. We are familiar with the form and pitfalls of the most common standard form contracts and will advise you how to deal with them.

Disputes

Some of our litigation clients have been older persons whose financial position has been damaged by the actions of someone they trusted or who have not been adequately protected by banks, financial service providers or other professionals. We act effectively and decisively for these clients to reinstate their rights.
